Preamble

These Terms of Use ("CGU") establish the legal framework for using the Smartfluence website and services. They constitute an agreement between the site manager ("Editor") and anyone accessing the site and its services ("User").

The service operator is Smartfluence SAS, located at 11 rue Saint-Lazare, 75009 Paris, France. Website: smartfluence.fr.

Users must accept these CGU to access the site and its services.

Article 1 — Principles

These CGU establish the legal framework for using the Smartfluence website and services. By using Smartfluence services, users also accept the YouTube Terms of Use, as Smartfluence uses YouTube API services to access public influencer data.

Article 2 — Evolution and Duration

These CGU have indefinite duration, effective upon service use commencement. Smartfluence reserves the right to modify clauses at any time and without justification.

Article 3 — Site Access

Free access is available to all internet users. The Editor is not responsible for user connection costs. The site may be interrupted or suspended without obligation of notice or justification.

Available services include the SaaS marketing platform. A paid member area exists for registered users accessing all Smartfluence services.

Article 4 — Responsibilities

The Editor cannot be held liable for site failures, malfunctions, or interruptions. Users bear full responsibility for their connection equipment and data protection against viruses.

The Editor is not responsible for judicial proceedings against users due to site usage or non-compliance with these CGU. Users waive any action against the Editor for damages resulting from site use.

If the Editor faces proceedings from user site usage, the user must indemnify all resulting damages and costs.

Article 5 — Intellectual Property

All technical documents, products, photographs, texts, logos, drawings, videos, and other materials are subject to copyright and protected by intellectual property law. These materials remain Smartfluence's exclusive property.

Users commit to not using documents in ways that infringe intellectual property rights and pledge non-disclosure without express written Editor authorization.

Article 6 — Hyperlinks

User creation of hyperlinks to the site requires prior written Editor authorization via the contact form. The Editor may refuse authorization without justification. Any granted authorization is temporary and revocable without notice.

Content accessible through external links is not Editor-controlled. The Editor disclaims all responsibility for third-party site content.

  • Connection: login data, usage data, location data, payment data.

Smartfluence uses YouTube API services to access public influencer data. Users acknowledge and accept this usage. Google privacy information is available at Google's Privacy Policy. Users may revoke Smartfluence YouTube access via Google security settings.

Clause Evolution

Smartfluence reserves the right to modify this data protection clause at any time. Modifications will be published on the site with a 15-day minimum notice via email before the effective date. Users who disagree may delete their accounts.

Article 8 — Cookies

Smartfluence uses cookies for traffic monitoring, design and layout development, administrative and planning purposes, and service improvement. We use tarteaucitron as our cookie consent management platform, which allows users to manage their preferences in compliance with GDPR.

Cookies requiring consent (Google Analytics, HubSpot) are activated only after explicit user approval. Plausible Analytics does not use cookies.

Article 9 — Applicable Law

French law governs these CGU. The parties commit to seeking amicable solutions for any disputes. Unresolved disputes fall under the jurisdiction of French courts.
